Terms of Service

By accessing or using NAWA (the "Service"), operated by Nawa Labs FZ-LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By creating an account, you represent and warrant that you meet this requirement.

NAWA is an AI-powered community management platform that provides:

• Automated comment moderation
• AI-generated reply suggestions
• Sentiment analysis
• Engagement analytics for social media platforms including YouTube, Instagram, TikTok, and X

The Service uses a 3-tier agentic AI engine powered by Anthropic Claude models to generate reply suggestions that match your communication style. The Service includes semantic caching, pattern recognition, and premium AI model access depending on your subscription tier.

We continuously improve and update the Service. Features may be added, modified, or removed. We will provide reasonable notice before removing features that are core to your subscription plan.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use of your account.

Platform Connections

When connecting social media platforms via OAuth, you grant NAWA permission to access your platform data as described in our Privacy Policy. You may revoke platform access at any time through your account settings, which will disable related features for that platform.

Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. We reserve the right to suspend or terminate accounts that contain inaccurate or fraudulent information.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:

• Generate spam, harassing, or abusive content
• Impersonate others or misrepresent your affiliation
• Circumvent platform rules of connected social media services
• Distribute malware or engage in phishing

Content Responsibility

You are solely responsible for the content generated through your account, including AI-generated replies that you approve and send. While NAWA provides safety scoring and content moderation, you remain responsible for reviewing and approving content before it is posted to your social media platforms.

Enforcement

We reserve the right to suspend or terminate your access to the Service if we reasonably believe you are violating these Terms or using the Service in a manner that could harm other users, third parties, or the integrity of the Service.

The Service generates reply suggestions using artificial intelligence. While our AI is designed to match your voice and maintain quality, AI-generated content may occasionally be inaccurate, inappropriate, or not aligned with your intent. You should review all AI-generated replies before sending them.

Operating Modes

• Semi-Auto mode: All AI-generated replies require your explicit approval before being posted.
• Full-Auto mode: Replies are posted automatically based on your configured rules and safety thresholds. You acknowledge that you are responsible for configuring appropriate safety settings and monitoring automated replies.

Disclaimer

NAWA does not guarantee that AI-generated content will be free from errors, bias, or unintended meanings. Our safety scoring system provides risk assessments, but no automated system can catch every potential issue. We recommend regular review of AI performance through the analytics dashboard.

Platform IP

The NAWA platform, including its software, design, logos, and documentation, is the intellectual property of Nawa Labs FZ-LLC and is protected by applicable copyright, trademark, and other intellectual property laws.

Your Content

You retain full ownership of your content, including social media comments, AI voice profiles, and any data you provide to the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing and improving the Service.

AI-Generated Replies

We do not claim ownership of AI-generated replies created through your account. Once generated, those replies are yours to use as you see fit. We do not use your content or AI-generated replies to train external AI models without your explicit consent.

To the maximum extent permitted by law, Nawa Labs FZ-LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. This limitation applies regardless of the legal theory under which the claim is made.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will meet your specific requirements or expectations.

Voluntary Termination

You may terminate your account at any time through your account settings or by contacting support@trynawa.com. Upon termination, your subscription will remain active until the end of your current billing period, after which your account and data will be scheduled for deletion.

Involuntary Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. In cases of suspension for investigation, we will notify you of the reason and expected timeline.

Data After Termination

Upon account deletion, all personal data will be permanently erased within 30 days in accordance with our Privacy Policy. You may request a data export before deletion by contacting support@trynawa.com.

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Ras Al Khaimah, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the RAKEZ Dispute Resolution Centre. The arbitration shall be conducted in English in Ras Al Khaimah, UAE.

Exceptions

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm. For users in the European Union, these Terms do not affect your rights under mandatory consumer protection laws of your country of residence.
